F O U N D:

 

Based on the complaint (registration number No____) by  __________ __________ and  __________ __________, the High Council of Justice of Georgia initiated disciplinary proceedings against the judge __________ __________included in the reserve list of the common courts of Georgia.

As per the decision of the High Council of Justice of Georgia, the judge __________ __________ included in the reserve list of the common courts of Georgia has been imposed disciplinary responsibility for the commission of misconduct – Severe Violation of the Law in Fulfilling Judicial Authority foreseen by the subparagraph “a” of the paragraph 2 of the article 2 under the Law of Georgia on “Disciplinary Responsibility And Disciplinary Proceedings Of Judges Of Common Courts Of Georgia”.

Prior to the trial of the case with Disciplinary Committee Of Judges Of Common Courts Of Georgia, the judge __________ __________ included in the reserve list of the common courts of Georgia has been removed from the reserve list and dismissed from the occupied position upon personal motion in accordance to the subparagraph “a” of the paragraph 1 of the article 43 under the Organic Law of Georgia on “Common Courts of Georgia” and subparagraph “i” of the paragraph 1 of the article 4 of the Regulation on Judicial Reserve approved by the High Council of Justice with its Decision No1/210-2007 of September 5th 2007.

Disciplinary Committee of judges of common courts of Georgia held that the disciplinary proceedings against Disciplinary Committee shall be terminated as pursuant to the subparagraph “c” of the paragraph one of the article 49 under the Law of Georgia on “Disciplinary Responsibility And Disciplinary Proceedings Of Judges Of Common Courts Of Georgia”, the Disciplinary Committee shall make a decision to terminate disciplinary proceedings on a case if the judge against whom the disciplinary proceedings have been initiated, resigns until the completion of the disciplinary case trial and/or his/her judicial authority is terminated.

Disciplinary Committee was guided by the subparagraph “c” of the paragraph one of the article 49 and article 57 of the Law of Georgia on “Disciplinary Responsibility And Disciplinary Proceedings Of judges Of Common Courts Of Georgia” and

 

H E L D:

 

1. Disciplinary proceedings against __________ __________ shall be terminated;

2. The copies of the decision of the Disciplinary Committee of judges of common courts of Georgia shall be submitted to the persons and bodies determined by the law;

3. The decision may be appealed with the Disciplinary Chamber of the Supreme Court of Georgia within 10 days upon its submission through the Disciplinary Committee of judges of common courts of Georgia.
